Georgia workers' compensation is no fault: if you were hurt on the job you are covered whether or not anyone was careless, and in exchange you generally cannot sue your employer. Report the injury to your employer within 30 days and file a WC-14 with the State Board of Workers' Compensation within one year.
Benefits are two thirds of your average weekly wage up to the state cap, plus medical care from a doctor on the employer's posted panel. Attorney fees are capped at 25 percent of benefits and must be approved by the Board. A separate personal injury claim may exist against a third party, such as another driver.
