Georgia is an attorney closing state: only a licensed Georgia attorney may conduct a real estate closing, examine title and disburse funds. The closing attorney usually represents the lender, so a buyer or seller who wants their own advocate hires a second lawyer to review the contract and the closing statement.
The closing attorney searches the title, clears liens, issues title insurance (an owner's policy is optional but usually worth it), prepares the security deed, and records everything with the county. Georgia charges a transfer tax of $1 per $1,000 of price and an intangible tax of $1.50 per $500 on a new loan.
